Consign and Design Gallery NM Consignment Agreement
This Consignment Agreement (“Agreement”) outlines the terms under which items are consigned with
Consign and Design Gallery NM (“Consignee”). By consigning items, the consignor (“Consignor”)
agrees to the following terms:
1. Accepted Merchandise
Name-brand items only. Items are accepted at the sole discretion of the Consignee. Acceptance does
not guarantee sale.
2. Pricing & Sales Authority
The Consignee sets all pricing and controls participation in sales, promotions, markdowns, and
clearance as part of normal retail operations of Consign and Design Gallery NM.
3. Consignment Period & Commission
Consignment period is 120 days. Commission split is 60% Consignee / 40% Consignor, based on final
sale price.
4. Unsold Items
After 120 days, items may be picked up or moved to clearance pricing. Unsold clearance items are
Turned over to store inventory or donated to a local charity at the sole discretion of Consign and Design Gallery.
5. Loss, Theft, & Liability
Items are consigned at the Consignor’s risk. Consign and Design Gallery NM is not liable for loss, theft,
or damage.
6. Item Pickup Authorization
Only the owner listed in the store’s consignment records may sign out or retrieve consigned items.
Identification may be required at pickup.
